The not so smiley 62-year-old, known to fans as Smiley Miley, appeared at North Somerset Courthouse in St Georges on January 21.

The divorcee did not act on two enforcement notices given by North Somerset Council in 2008, which instructed him to remove two marquees.

For failing to do so he was slapped with a £2,500 fine and a 24-month conditional discharge.

The first marquee at an area near the junction south of Station Road and Clevedon Road was put up in 2007 and a second smaller marquee was later put up.

Plastic chairs, trays and other traces of social events were also left on the land, which should be for agricultural use only.

Sally Andrews, prosecuting on behalf of the council, said if Miles wanted to keep the marquees he should have applied for planning permission.

Instead, the cost of the investigation, which lasted more than year, mounted to £3,332.

It was not until a member of the public complained that the issue initially arose.

Ian Kelcey, defending, said the marquees were used for charity socials and that Miles was unable to take them down due to a 'catastrophic history of health problems'.

He said: "He approached the problem with an ostrich like approach and buried his head in the sand.

"We all know what happens when you stick your head in the sand, your posterior is there to be kicked. And I am asking you to kick him ever so gently please."

Mr Kelcey, who also described Miles as 'foolish', said that he has had no financial benefits from the charity socials and that he was only just about managing financially.

He said: "He has been retired for many years and he ekes a living."

Mr Kelcey went on to explain how, despite Miles being a well-known disk jockey back in the day, his income is now less than his outgoings.

Speaking afterwards Miles said: "I was using the marquees for a school ball, which helped raise thousands of pounds for charity.

"I think the cost given to me was very harsh.

Miles, of Flax Bourton Road, Failand, took the last structure down two days before appearing in court.
