THE family of a five-year-old girl who drowned after getting stuck in Berrow's mudflats in 2002 is waiting to hear whether its legal battle with Sedgemoor District Council has been successful.Lelaina Hall died while holidaying in the resort four years ago and her family is now waiting to find out if the council will be held responsible for an alleged breach of care. The family says there was a lack of signs warning visitors of the dangerous mud.Her mother Caroline Hall, aged 35, from Worcester, is hoping the result of the four-year lawsuit will stop the same thing happening to other families. A decision is due on October 11.An inquest into Lelaina's death in October 2002 heard how the young girl had been allowed to run off and play, under the watchful eye of her mother and her partner, because they had not seen any warning notices.She became trapped in the mud and was swept out to sea where she drowned.Since Lelaina's death, warning signs have been put up along the coastline in Berrow and Ms Hall is hoping the council will continue to improve the signage to prevent further tragedies.Sedgemoor District Council was unable to comment on the court case as it is still ongoing. The case was heard in Yeovil County Court last November and the decision is due to be given at Taunton County Court in a couple of months.
